Hibbing man charged with raping, assaulting woman

HIBBING — A man faces multiple felony charges after allegedly raping and seriously assaulting a woman last week.

Delton Roy Misquadace, 35, of Hibbing, was arraigned Monday in State District Court on two counts of first-degree criminal sexual conduct and one count of domestic assault by strangulation.

A criminal complaint says the alleged victim told authorities Misquadace choked her to the point that she was “afraid that she might not make it out alive.”

Hibbing police responded to a residence around 2 a.m. Friday, finding the victim outside crying and afraid to go back inside. She said she had known Misquadace for about a year and that he had given her a ride earlier Thursday before coming over that night.

The complaint says they had a few drinks before engaging in what started as consensual sex but quickly turned “aggressive” and “degrading.” She reported that Misquadace choked her for about a minute, leaving her unable to breathe and nearly causing her to pass out.

The woman said she told him “no” about four or five times, but the defendant continued with the physical and sexual assault, which also included biting and slapping her.

The complaint says Misquadace went to sleep after the assault, and the woman called a friend, rather than 911, out of fear of retaliation. Officers reported bruises consistent with her account.

Misquadace, when arrested, initially refused to answer questions about sex but went on to deny raping or hurting the alleged victim. He also made comments about “taking on officers,” according to the complaint.

Judge Andrew Peterson set bail at $100,000, consistent with a request from St. Louis County prosecutor Jeff Vlatkovich.

Misquadace has prior felony convictions for fourth-degree criminal sexual conduct and violating predatory offender requirements. He also has several gross misdemeanor offenses on his record in Minnesota, including domestic assault.

His next court appearance was set for May 9.
